A quick report back. Julio is still here. He wasn’t deported yesterday as he was told he would be. This means we have a few extra days to push ICE to grant discretion and allow for him to stay. Julio’s family has filed all the appropriate paperwork, now we just need ICE to make the right decision.
The ICE office in Chicago is the one in charge of Julio’s case which is why we are asking Senator Durbin to intervene in the first place. It is Senator Durbins job to ensure that the ICE office in his home-state is applying discretion appropriately.
Despite hundreds of your calls the Senator is still refusing to support Julio. The last thing we caught his office telling Julio’s supporters is that “the Senator only cares about Illinois families.” This is the last thing we expect to hear from a Senator fighting to reform immigration laws for all of our families.

“Hi, I was suprised to hear that the Senator is refusing to help Julio Berti (A#078-962-892). Julio does not live in Illinois however the ICE field office in Chicago is in charge of his file. Chicago is the ones denying his request for discretion. If the Senator is really a champion for immigrants then why won’t he help find a way to help Julio re-unite with his family?“
All Senator Durbin has to do is pick up the phone and call Janet Napolitano or John Morton, the directors of DHS / ICE, and ask them to stop Julio’s deportation. If you call his office after hours don’t fret; help us fill up his voice-mail box with messages in support of Julio.
Without Senator Durbin’s support it’s very likely Julio will never see his family again.
