A. Instate Tuition: No, Michigan currently does not offer instate tuition to immigrants without legal status.

B.    Drivers Licenses: No, a recent opinion by Attorney General Cox states those without legal presence in the United States cannot qualify for a Michigan Drivers License as they do not ultimately qualify under the residency requirements.

Wisconsin

A. Instate Tuition: No.

B. Drivers License: Due to the passage of Bill 69 you must meet the following criteria to qualify for a drivers license and/or state identification card:

I. Provide proof of U.S. citizenship, legal permanent resident status, conditional resident status or temporary visitor status;

II. Provide proof of name and date of birth;

III. Provide proof of identity;

IV. Provided proof of Wisconsin residency;

V. Hold an Instruction Permit for at least seven days (unless you hold a valid foreign driver license and have passed the knowledge test);

VI. Pass the driving skills test; and

VII. Pay the necessary fees.

C. Pending Legislation:

· The 2007 / ­2008 biennial budget bill (2007 Senate Bill 40) would allow for undocumented children to attend technical college without having to pay out of state tuition. The requirements to qualify for this are similar to those in many other states, namely that you have graduated from a WI high school.

· 2007 As­sembly Bill 101 would punish employers that hire illegal immigrants. This legislation was also proposed in 2005, it was referred to the Assembly Commit­tee on Labor, where it died.

· 2005 Senate Bill 567 (now a part of 2007 Senate Bill 40) would require documentary proof of citizenship from any person applying for public assis­tance from the Wisconsin Department of Health and Family Services or the Wisconsin Department of Workforce Development. Public assistance includes low­ income ser­vices such as Wisconsin Works income assis­tance, medical assistance, and food stamps.

Illinois

A. Instate Tuition: Yes, for an undocumented immigrant to qualify for instate tuition in Illinois she/he must:

I. Reside with his or her parent or guardian while attending a high school in Illinois;

II. Graduate from a high school or receive a GED in Illinois;

III. Attended school in Illinois for at least 3 years as of the date the individual graduates from high school or receives a GED;

IV. Register as an entering student not earlier than the fall of 2003 semester; and

V. Provide an affidavit stating that he or she will file an application to become a permanent resident of the United States at the earliest opportunity the individual is eligible to do so.

Illinois HB 1743 (Signed 8/13/2007) This law relates to immigrant employment eligibility verification of social security numbers and Homeland Security databases. It provides for the regulations of civil rights violations for an employer participating in the Basic Pilot Program and prohibits discrimination on the

basis of citizenship.

Illinois HJR 27 (5/22/07) This resolution expresses opposition to the REAL ID Act and asks that it be repealed.

Indiana SB 463 – Act 184 (Signed 05/08/2007)

The act amends the contents of and application procedure for a driver’s license, learner’s permit, or identification card to comply with federal law; provides for varying expiration dates for a driver’s license, learners’ permit, and identification cards based on the holder’s lawful status in the United States and regulates social security cards; relates to registration of a vehicle brought in from another state. It requires these applicants to be U.S. citizens or legal resident aliens.
