SB 144 – Chapter 85 (Signed 03/23/2007)

This legislation relates to driver’s licenses and requires applicants to be U.S. citizens, permanent residents or of other lawful status. The law also requires agencies that are hiring telecommunicators to be U.S. citizens or legal resident aliens.

SB 104 (introduced to senate 1/24/08) AN ACT relating to certificates for driving. Create a new section of KRS Chapter 186, to define the term “certificate for driving” as a certificate issued by the Transportation Cabinet to an individual who cannot prove citizenship or legal presence requirements of KRS 186.412; mandate that certificates for driving be clearly distinguishable from regular operator’s licenses and clearly state on the face that the document is not to be used for identification purposes.

The law requires certain professionals to be U.S. citizens or legal resident aliens in order to receive the appropriate professional licensing (endowed care cemeteries, landscape architects, chiropractor training, funeral directors and embalmers, physical therapists, professional counselors, social workers, family therapists, pharmacy interns and real estate appraisers).

North Carolina

A. Instate Tuition: No, however, in November of 2007 the North Carolina Community College System (NCCS) issued a memo stating that ALL community colleges MUST accept undocumented students who have graduated from a North Carolina high-school. The memo specifically states at “out of state” rates, however, it does leave room for each individual school to issue tuition waivers.

South Carolina HB 3620 (Signed 6/29/2007)

The bill specifies that undocumented immigrants may not receive tuition assistance, scholarships, or any form of student aid for higher education in South Carolina.

South Carolina SB 449 (Signed 06/13/2007)

The act states that South Carolina will not participate in implementation of the Real ID Act that would otherwise seek to define citizenship and alien status in the United States.

HB 407 / SB 1616 Requires verification of immigration status for state benefits; requires state agencies to report illegal immigrants to federal authorities.

SB1870 / HB0877 This bill requires persons who hire employees on and after January 1, 2008, including contract employees, to verify immigration status prior to hiring an individual. Such verification would be accomplished by:

SB 903 – Chapter 220 (Signed 5/24/2007)

This legislation prohibits the use in the state of a federal individual taxpayer identification number (ITIN) as a form of identification to prove immigration status.

HB 600 – Act 242 (Signed 06/01/2007)

The act prohibits the transportation of illegal aliens into the state, imposes a fine for such violation, and requires that money received from such fines be applied to the costs associated with deportation of such illegal aliens.
