You can relate this point to the DREAM Act. heck we even jail our asylum seekers contrary to International law (Article 31 of the UN Refugee Convention). Also, the Bush Admin has successfully appointed a number of immigration judges who are tough on asylum rules and hardly grant asylum. Where you live also drastically changes your chances of asylum.
